By ordering a commission from me, Strawbvnnii, ("I, the Artist"), you ("the Client", "you, (s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/or a blacklist/public service announcement. You cannot trace or copy any of my artwork.
You agree that my artwork and designs are NEVER to be used for NFTs or run through AI. Do not use my work to promote and/or earn crypto currency.
All commissions are personal, non-commercial/non-profit use only. Do not resell or use my art as merchandise unless stated otherwise.
No refunds after the commission is finished.ARTIST
I have the rights to all copyrights of my artworks. I can advertise and display any artwork of mine unless commissioner requested privacy.
I have the right to decline any commission request.COMMISSIONER
Commissioner has the right to re-upload their commission wherever as long as they credit me.
Commissioner cannot claim their commissioned artwork as their own.
Commissioner cannot edit their commissioned artwork unless permission was given.
Commissioner cannot use their commissioned artwork for commercial purposes unless we discussed otherwise.
YouTube/Twitch and Merchandise: A contract with be drafted depending on the circumstances we discussed.
NFTs: Do not use my work to promote and/or earn crypto currency.
Personal Accessories: It is permitted as long as the items are not used to sell commercially.PAYMENT
I only accept USD via Cashapp, Venmo and PayPal as payment.
The entire payment must be paid in order for me to start the commission.
Once I received the payment in full, the sketch of the commission will be sent over for edits and approval.
Request for refund is available during the sketch stage of the commission. After it is approved, the option is off the table.PROCESS
Payments must be made in FULL before I start the commission. Please be sure to have all required funds for your commission or the commission will be declined.
You understand all commissions will be done digitally. There will be no hard copies. The Client is paying for a service/digital good and will not require any shipping of any kind.
I will send sketches of said commission via specific social media messaging method. Large edits are allowed during this stage.
After the sketch has been confirmed for finalizing, only small edits can be made during this stage.
Commissions can take 1-4 months to be completed at max. I will notify you of any delay.
Once the commission is done, full resolution PNG files will be sent via discord or email.DESIGN T.O.S;GENERAL
You cannot trace or copy any of my designs.
You can only trade or sell the design if you are the owner of said design.ARTIST
I have the right to all copyrights of my designs' artwork. I can advertise and display any artwork of mine that portrays the design, however I will not profit off of it.
I have the right to decline trading or selling designs to any users for any reason.DESIGN OWNER
NFTs: Do not use my work to promote and/or earn crypto currency.
Owner can use the design on closed species or create different versions of it as long as they will all be traded or sold together and my original work stays included. Do not remove my original design/artwork!
Owner can make edits to the design as long as the character is still recognizable to the original.
Owner can make SLIGHT edits to my artwork of the design they bought, such as removing some elements or color changes, but you may never take credit for the artwork I made. Please leave a version of the original art intact as well.
Owner cannot claim their design as their own creation under any circumstance. I must always be credited for the initial design. Owner has the right to upload their design to other they like as long as they credit me.
Owner cannot use the design for commercial purposes unless we discussed otherwise. Commercial use will be granted for any design that I have received at least $300 in total for.
Do not use my designs for Twitch/Vtubing unless you have purchased commercial use rights.
Personal Accessories (ie; making a keychain, shirt, etc with the character design in question): It is permitted as long as the items are not used to sell commercially. The items can be traded/gifted/resold to the new owner when transferring the design's ownership. Do not resell for more than what you purchased it for/resell for profit.
If you purchase my design on toyhouse, DO NOT delete the character and re-upload it, EPECIALLY without credit to me. This removes transfer history (where I input the $ value of the design) and trust, it also removes my watermark from the design. If you do this I will likely be hesitant to sell to you again in the future.
If you buy a character from me on toyhouse. I request that you do not remove my watermark from my drawings/designs out of respect and credit to me.TRADING/SELLING
The design can be gifted.
The design can be traded for other design/s, physical items, art services, etc.
The design can be sold at a higher value if commissioned art is attached. Do not resell for profit. Reselling cannot exceed the cost of the commissioned artwork + design worth combined.PAYMENT

A payment plan may be available under certain conditions and it must be previously discussed with me before buying.
Request for refund is not available after I sent the files over.
I will only accept a payment plan if the design is over $150.
The maximum time for a payment plan is 2 months unless discussed otherwise.
The payment plan will include a 50% down payment, and the rest can be paid periodically depending on the discussed agreement.
You will receive two notices/reminders, one per 3 days, when the payment plan is past due.
Once you've passed those two notices, the payment plan will no longer be valid and I will refund the payment back.
If I ask for payment and you surprise me with a sudden payment plan that I wasn’t already aware of, I have the right to move on to the previous bidder.COPYRIGHT + USAGE POLICY
I, The Artist, hold every right to the produced drawing, not The Client. Therefore, I’m allowed to use the copyrighted artwork to: Promote myself within any place or website, To display or post it where I like.
WITHOUT commercial purchase, the CLIENT is allowed to: Use the copyrighted artwork for personal use, Print the art for themself (and claim the right of their character(s) but not the drawing itself).
Commissions are for personal use only unless otherwise stated. You cannot use my commissions for merchandise or resale. You may pay to have rights of the design for commercial use and resale. Credit is still required for usage of the artwork
If you wish to purchase a design/artwork commercially contract with be drafted depending on the circumstances we discussed.
Do not redistribute my work on any site without crediting me.
If you redistribute the commissioned works without paying the release fees/royalty agreement, I reserve the right to decline future commissions.
